Ordering
Payment for this site is handled via Stripe, through Squarespace, and all transactions go directly through Stripe. You will receive a confirmation email from “Clever Endeavour Games” when the payment goes through.
We promise to protect your card information and security to the best of our ability. Your card information will only be visible to us and to Stripe (payment processing service), and will never be shared or sold to anyone. Despite high security measures, we cannot guarantee that we can protect your personal information against unauthorized third parties, and you agree that providing such information is done at your own risk.
Rejection or Cancellation of Orders
Clever Endeavour reserves the right to reject or cancel any order with no obligation to fulfill the order, provided that in such case you will have no obligation to pay Clever Endeavour. In any situation where additional information is needed to complete an order, Clever Endeavour will contact you to request such information.
Availability and Description of Products
If a product becomes unavailable, Clever Endeavour has no obligation to process your order and you have no obligation to pay Clever Endeavour.
We try our best to make sure that all colours, sizes, material, and other physical characteristics of our products are properly represented. We cannot represent or warrant that the product descriptions or other content on this site are complete, accurate, reliable and error-free, based on a number of factors including screen brightness, screen colour, screen size and resolution, currency of information and other factors.
Price
By confirming your purchase, you agree to pay the amount listed as “Grand Total” in the Order Summary section of the Checkout page, including all applicable sales and similar taxes and shpping costs. The purchase price will be charged in Canadian Dollars to your selected credit card.
In the event that an item is listed at the wrong price, Clever Endeavour reserves the right to cancel any orders made at that price. We will contact you with the details about the problem and request that you place another order if you remain interested in the product.
Quantity Limits
Clever Endeavour reserves the right to limit quantities purchased. We will notify you if an order is placed and this is the case.
Method of Payment
Clever Endeavour, via Stripe and Squarespace, accepts Discover, MasterCard, Visa, and American Express credit cards. Other payment methods such as debit cards and cheques are not accepted; please contact us if you need to make a payment by any other means.
Shipment
You will receive an email when the product ships. As shown on the Checkout page, the customer is responsible for paying for shipping.
Return Policy
All returns / exchanges must be done within 30 days of receiving the product.
If a product is defective, it can be returned to Clever Endeavour at the address listed in our Contact Us page. Unfortunately, we cannot refund the initial shipping costs, but will refund the cost of shipping to return the product to us if it is defective.
If a size is wrong or the style is not as desired / expected, it can be exchanged at no cost, except that we will not pay any shipping costs.
Cancellation
You may have certain statutory rights to cancel your order under applicable provincial consumer protection laws and Clever Endeavour will respect all such applicable laws.
Privacy
The way in which we handle your personal information, including the collection, use and/or disclosure of your personal information and/or financial information, is discussed in our Privacy Policy.
Changes to Terms of Sale
The Terms of Sale applicable to your order are the Terms of Sale in effect on the date that you place your order, as made available to you when you complete the checkout process. Clever Endeavour may modify its Terms of Sale from time to time in accordance with applicable laws. Any such modification will apply to any order placed after the effective date of the modification. Therefore, each time you place an order with Clever Endeavour you represent that you have accessed, read and accepted the Terms of Sale applicable to that order.
Disclaimers of Warranties
To the maximum extent permitted by applicable laws, Clever Endeavour disclaims all warranties and conditions of any kind, whether legal, express or implied (including warranties and conditions of merchantable quality, merchantability, quality or fitness for a particular purpose and non-infringement), relating to this site or any content, information or goods accessed, offered, purchased or sold through this site or their use, suitability or availability or any transaction conducted on this site, whether arising from statute, course of dealing, usage of trade or otherwise. Clever Endeavour makes no representations or warranties and provides no conditions in connection with this site or any content, information or goods accessed or offered through this site or their use.
Some jurisdictions do not allow the limitation on implied warranties and conditions. If these laws apply to you, some or all of the above disclaimers may not apply to you.
Limitations of Liability
In no event shall Clever Endeavour be liable for any direct, indirect, incidental, special, exemplary, punitive or consequential damages of any nature (including loss of use, loss of data, loss of profit and loss of savings) to you including for damages arising in connection with or relating in any manner whatsoever to: (A) this site; (B) any content, information or goods accessed, offered, purchased or sold through this site or their use, suitability or availability (including the inability to use); (C) any transaction conducted on this site; and (D) any unauthorized access to or alteration of your data.
If the above exclusion or any portion thereof is found to be invalid or unenforceable for any reason, then the aggregate liability of Clever Endeavour for damages of any nature suffered by you shall in no event exceed the Purchase Price of your transaction.
The above exclusion and limitation of liability shall apply whether or not a claim is in contract, tort (including negligence and product liability), strict liability, restitution, breach of statute or any other theory of law and even if Clever Endeavour had been advised or had reasons to know of the possibility of such damages.
In this Section, reference to “Clever Endeavour” means Clever Endeavour and its affiliates and its and their respective officers, directors, employees, contractors, mandataries and agents.
Certain jurisdictions do not allow the exclusions of damages as provided above. If these laws apply to you, some of the exclusions referred to above may not apply to you. This Section shall apply to you to the maximum extent permitted by applicable laws.
Export
You acknowledge that some of the goods purchased through this site may be subject to customs or export control laws and taxes.
Applicable Law
These Terms of Sale will be governed by the laws of the province of Quebec and the laws of Canada applicable therein unless the applicable laws of your province of residence require that the laws of such province govern, in which case, the laws of such province are to govern. The exclusive jurisdiction for any claim, action or dispute with Clever Endeavour or relating in any way to your use of the site or a purchase made on the site will be in the courts of the province of Quebec unless required otherwise by applicable laws of your province of residence.
